Terms and Conditions

Please read these terms and conditions carefully before registering to participate in “Fuelling Ka Maha Utsav” (referred to as "Offer"). By proceeding with your registration and participation in this campaign, you hereby acknowledge, accept and thereby agree on an irrevocable basis to be legally bound by these terms and conditions. 

1. This campaign offer is open to Indian Citizens living in India only who have attained the age of 18 years or above (Participants). Entries by person below age of 18 years shall be disqualified.

2. Employees of the organizer i.e. Bharat Petroleum Corporation Ltd. (BPCL), BPCL Dealers & their employees / Distributors / Channel partners / employees of Advertising Agencies of BPCL, Service providers/Event managers etc. associated with this offer and their families, are not eligible for participation.

3. Offer commences on 22nd Sep’24 and closes on 15th Nov’24 at midnight (referred to as "Offer Period"). 

4. Entry to this offer shall be treated as void wherever (including any State or Union Territory) such offers are prohibited under local laws.

5. The offer is available at select BPCL (Bharat Petroleum Corporation Ltd) Retail Outlets across geographies. The list of Retail Outlets where the offer is available is displayed on www.bharatpetroleum.in > Bharat Petroleum for > Your Corner > contest corner, at the end of this document. BPCL reserves right to add or remove retail outlet at its discretion at any given point in time during campaign period. 

6. Participation in this offer is deemed acceptance of these Terms and Conditions.

7. By entering this offer, the participant agrees that the information entered in the registration form and the mobile numbers from which the entries are received may be used by BPCL for research about this offer or communicate future promotions and other messages to the participants of this offer and the participant gives express consent for the same. By participating in this offer, the participant confirms and waives off the applicability of rules and regulations of National Do Not Call Registry. 

Process for participating in the offer is given in points 8 to 12.

8. Only those customers who purchase Rs. 200 or above worth Petrol / Speed for 2/3 Wheelers & Rs. 1000 or above worth Petrol/Speed for 4 Wheelers (Cars /SUVs/MUVs) are eligible to participate in the lucky draw by scanning QR code & Sending Sms placed at the Retail Outlet and filling in required details (Mobile number, name, amount of Petrol/Speed purchased, vehicle type and bill number).  Participating customers are also required to upload image (photo) of bill in the portal at the time of registration. Customer will get confirmation SMS regarding participation once he/she completes this. The confirmation SMS means customer’s entry is registered for electronic draw at scheduled dates/period.

9. If customer wins any gift in lucky draw, he / she would get an SMS or What’s app message or call to claim the product at the RO. 

10. Neither BPCL nor its dealers or its agency shall be liable or responsible, if for any reason the customer is not able to scan QR code or receive SMS, due to any technical error or otherwise or towards the products being given as a free gift.

11. A customer can buy fuel (Petrol/Speed) any number of times as per eligibility and can participate in the offer during offer period as per eligibility mentioned in Point no 8. However, only one entry will be valid for one bill number.

12. The customer is required to preserve the original Bill of the purchase OR photo image of the bill taken on mobile, based on which the customer has entered the offer, for claiming the prize, if any, won by him/her. Loss/mutilation of the original Bill / non availability of photo image shall disqualify the customer from claiming the gift. 

13. BPCL / its authorized agency reserves the right to conduct verification of the bills issued to customers from the retail outlets. 

14. On completion of the campaign or as per the draws scheduled by BPCL /its agency, electronic lucky draw at the back end will be conducted for the eligible participants for selecting lucky winners as per the below mentioned prizes.

                a. Weekly draw (6 weeks 6 draws @ 1 draw every week) :  BPCL fuel gift e vouchers to 2 winners from each sales area worth 500 each : Total 3600 Lucky Winners will get this during offer period.

               b. Monthly Draw (after one month into offer ~ 23rd Oct’24 for entries till 22nd Oct’24) 

i. Pencil brand vegetable chopper or equivalent brand/model: 3 Lucky winners per eligible & participating Retail Outlet (approximate 11000 ROs, approx. 33000 winners)

ii. Pigeon 16 pcs Dinner set or equivalent brand/model: 1 Lucky winner per eligible & participating Retail Outlet (approximate 11000 ROs, approx. 11000 winners)

              c. Mega Draw (after completion of campaign/offer) 

i. Mahindra THAR (Manual, 1197CC, Petrol) including Taxes and Gift Tax (On Road) – 1 number at all India Level

ii. Maruti Spresso Car LX1 including Taxes and Gift Tax (On Road) - 1 per region : Total 4 lucky winners (1 each in WR,ER,SR,NR)

iii. Hero HF model hundred, including Taxes and Gift Tax (On Road) - 1 per territory : Total 72 lucky winners (1 each in of 72 BPCL territories across India)

iv. Smart Phones, Vivo T3, 5G phone or equivalent model. 1 winner per each sales area : Total 300 lucky winners (1 each in of 300 BPCL Sales Areas across India)

v. Premier Electric rice cooker or equivalent model, 1 litre - 1 Lucky winner per eligible & participating Retail Outlet (approximate 11000 ROs, approx. 11000 winners)

vi. BPCL UFill/Speed printed Backpacks: 1 Lucky winner per eligible & participating Retail Outlet (approximate 11000 ROs, approx. 11000 winners)

vii. Nu republic Impulse EVO Silver, Smart Watches or equivalent model: 1 Lucky winner per eligible & participating Retail Outlet (approximate 11000 ROs, approx. 11000 winners)

viii. Hot Water kettles, Pencil Brand or equivalent model : 1 Lucky winner per eligible & participating Retail Outlet (approximate 11000 ROs, approx. 11000 winners)

ix. VIP Titan Duffle bag or equivalent model : 1 Lucky winner per eligible & participating Retail Outlet (approximate 11000 ROs, approx. 11000 winners).

Insurance, road tax and Gift tax for THAR, Maturi cars and Bikes would being paid by BPCL/its Agency and customer will get these prizes completely free of cost.

              d. Over and above, each customer will get discount coupons either from BASICS Apparel brand, NU republic or Biryani by Kilo. Discount coupon code will be sent to customers along with participation message. Discount coupons are an assured complementary gift to each customer and BPCL reserves the right to stop the discount coupons at any given point in time.

15. Customer required to pay gift tax if any on gift items other than THAR, Maruti CAR and Hero Bike as per the law and then only customer can claim the gift.

16. Images shown in the creatives (hoardings, banners, standees or social media) are only for representative purpose and actual gifts might vary from image.

17. Lucky draw gifts will fall under the standard terms and conditions for warranty as defined/ provided by its manufacturers and BPCL will not be responsible for the same.

18. Winner Customer would need to provide identity documents like Aadhar Card / PAN card during verification before claiming the gifts. After verification, the Prizes will be handed over to the winners in person during a formal prize distribution ceremony or will be handed over at the Retail Outlet.

19. In case the customers are unable to produce any of the above-mentioned documents or unavailable to contact within one month of intimation, the customer shall forfeit the prize. The selected Mobile Numbers (winners) will be contacted by our back-end operator for further processing.  In case the mobile number has been changed/ terminated/ blocked/ out of reach, etc. BPCL/its agency will not be held liable for not being able to communicate/ handover the prize to the concerned winner.

20. No queries/ clarifications/ suggestions will be entertained on the modality of draw or the selection process which is entirely the discretion of BPCL.

21. The offer is not transferable and cannot be exchanged.

22. BPCL also reserves the right to audit any/all claims/winning entries to ensure that the Terms and Conditions of the offer have been met; and to request additional information regarding any and/or all such claims along with supporting documents.

23. BPCL and its partners/sponsors shall not be liable for any loss or damage, theft or any other mishap, whatsoever, that may be suffered as a result of participating in the offer or enjoyment of the prizes.

24. Results of the weekly draws, monthly draw as well as Mega Draw would be published on the BPCL website as well as special BLOG site being created for the offer. Details of BLOG site will be sent to customers along with confirmation message in the offer.

25. The offer is not transferable, i.e. offer is valid only for the mobile number through which customer had participated in the offer.

27. BPCL also reserves the right to amend/modify the terms, conditions, validity or any part thereof at its sole discretion without prior notice. Any changes will be displayed on BPCL website.

28. All rights, title and interest, including but not limited to the intellectual property rights, in the campaign material(s) and in any and all responses received shall vest with BPCL. 

29. Participation in the Offer is voluntary. Participation in this Offer constitutes acceptance of these terms and conditions. If a Participant is dissatisfied with the Offer or the Offer rules and/or any requirements of the Offer, or with these terms and conditions, his/her sole and exclusive remedy is to not participate in the Offer.

30. The Participant/s undertake and irrevocably and unconditionally permit Organizers to cover the Campaign through various media/platforms inter alia newspapers, radio, television, news channels, internet, point of sale materials, etc. Participants shall not raise any objection, protest or demur to such coverage and their use of name, voice, likeness, image, illustrations etc. by the Organizers in this regard.

31. The products MS & Speed are available at BPCL retail outlets, without this offer also.

32. Unenforceability or invalidity of one or more clauses in these Terms and Conditions shall not have an effect on any other clause in these Terms and Conditions and the remaining clauses shall be enforceable as per law.

33. BPCL shall under no circumstances be liable, whether jointly or severally, for any loss or damage suffered or sustained (including but not limited to consequential loss), including for personal injury or property damage suffered or sustained, as a result of acceptance of campaign offer. 

34. By entering the campaign, the Participant hereby releases and agrees to indemnify the Organizers from and against all liability, cost, loss or expenses arising out of acceptance of the free offer or participation in the Campaign including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission, or otherwise as well as any legal expenditure. 

35. Dispute: The courts of competent jurisdiction at Mumbai shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with, the Offer. Participation in the Offer is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including (without limitation) this clause. Further, all issues and questions concerning the construction, validity, interpretation and enforceability of these Terms & Conditions, or the rights and obligations of the Participants and/or the Organizers with respect to this Contest shall be governed and construed in accordance with the laws of the Republic of India.

36. BPCL indemnifies itself and/or any of its officials and representatives from any cost, damage, liability or other consequence of performance of their products offered as promotional prizes, under any applicable law.

38. For the state of Tamil-Nadu, there will not be lucky draw and the winner will be chosen based on slogan submitted. The customer of Tamil Nanu needs to write their own slogan in the registration form after “I love to fuel at BPCL Petrol Pumps because”………..……………………………. 

39. Technical Glitches: BPCL shall not be liable for any technical or network-related issues, including but not limited to failure of any entry to be received due to technical malfunction, error, disruption, or delay in the internet, network connectivity, or any other issues.

40. Force Majeure Clause:BPCL shall not be held liable for any failure to comply with its obligations under the offer due to circumstances beyond its reasonable control, such as acts of God, war, riots, civil unrest, natural disasters, or pandemics.

41. Handling Disputes Over Participation : In the case of any dispute related to eligibility, bill authenticity, or the manner of participation, BPCL’s decision will be final and binding on all participants. BPCL reserves the right to disqualify any participant found to be using fraudulent means to participate in the campaign.

42. Prize Distribution Timeframe: Prizes will be distributed within a stipulated period of 45 days from the end of the campaign, subject to the winner completing all verification processes.

43. Publicity Rights: Winners may be required to participate in promotional activities such as photos, videos, and interviews related to the campaign. By participating, participants give consent to BPCL to use their images, names, and likeness in media without additional compensation.

44. Non-Claimed Prizes: Prizes not claimed within a period of 30 days from the date of the announcement will be forfeited, and BPCL reserves the right to award the prize to another participant or dispose of it as they see fit.

45. Modification or Cancellation of Campaign: BPCL reserves the right to modify, extend, or cancel the campaign at any time without prior notice, for any reason, including but not limited to changes in regulatory requirements or unforeseen events.

46. Disqualification: BPCL reserves the right to disqualify any entry or participant found to be violating the terms and conditions or engaging in any fraudulent, misleading, or inappropriate conduct.

47.  The entries from 22nd September 2024 to 21st October 2024 will be considered for the Monthly draw (Bumper draw) and the monthly draw will be held on 25th October 2024. For Tamil Nadu, the best slogan submitted during the time period 22nd September 2024 to 21st October 2024 will be selected and the best slogan winner will be announced on 25th October 2024.
